The Local Land Charges Register consists of information that may be useful to prospective purchasers of land or property. The Register contains entries on any liabilities or constraints which may be attached to the land which will become binding on any new owner. Examples of the charges which are included in Register are: financial charges; improvement grants; tree preservation orders; Planning Agreements; Enforcement Notices; Conservation Areas; and Listed Buildings.
The Land Charges service maintains the register of local land charges and responds to applications for searches. Searches are normally carried out by a Solicitor or legal representative acting on behalf of a prospective purchaser. In addition, from July 2007 homeowners wishing to market their property will be required to provide a Home Information Pack (HIP) which will include property search information. It is expected that quite a number of companies/organisations will offer their services as HIP providers.
The Council's target for replying to searches is that all standard searches (ie excluding those with Part II optional enquiries) will be dealt with in 10 working days, of which 90% will be returned within 5 working days. Currently these targets are being met or exceeded.
