Transitional Applications

This page will tell you how to apply for a licence if you are the holder of an existing justices' licence.

Existing justices licence holders
Existing licence holders need to apply for a new personal licence during the transition period, 07 February 2005 to 06 August 2005, in order to benefit from the Act's 'grandfathering' provisions.

These are that all holders of justices' licences will automatically be granted a personal licences unless there are police objections on grounds of crime prevention. In which case a hearing will be held by the Council's licensing committee, unless agreed unnecessary by the licence applicant and the police.
To apply for a personal licence the following will need to be provided to us:

  • Completed application form  
  • Existing justices licence or certified copy thereof
    A photograph of applicant.
  • Completed declaration form that since the justices' licence was issued or renewed the applicant has not/has been convicted of a relevant offences (as specified in Schedule 4 of the Act) or foreign offences.
  • A statement providing details of any convictions for a relevant criminal offence or a foreign offence since the justices' licence was issued

A copy of the application needs to be given to your Chief Officer of Police within 48 hours of the application being made.

What photographs must I enclose?
Two photographs, on photographic paper, must be

  • taken against a light background so that your features are distinguishable and contrast against the background
  • 45 millimetres by 35 millimetres
  • full face uncovered and without sunglasses and, unless the applicant wears a head covering due to their religious beliefs, without a head covering

One photograph of the applicant must be endorsed with a statement verifying it as a true likeness by

  • the chief executive of the licensing justices for the relevant licensing authority
  • a solicitor or notary
  • a person of standing in the community
  • an individual with a professional qualification.

Decision making
Existing licence holders will be automatically granted a personal licence, unless, where there is a relevant criminal offence, there are police objections on the grounds of crime prevention. In which case a hearing will be held, by the Council's licensing committee.

Timing
Personal licences will not come into effect until the second appointed day (November 2005)
