Transitional Applications

This page will tell you how to apply for a licence if you are the holder of an existing justices' licence. If not please see refer to application for a new licence .

Existing justices licence holders
Applications for grants of premises licences that are to take effect before the end of the transition period (August 2005) will continue to be made through the licensing justices. Likewise, applications for public entertainment, cinemas, and theatre licences will need to be made to the Local Authority.

For licences to apply after transition, however, existing licence holders (or those who have the licence holder's consent) need to complete Part A of the application form for a new premises licence which must be received by the Council between 07 February 2005 and 06 August 2005.

To apply for a new premises licence the following will need to be supplied to us

  • Details of existing licensable activities and whether this includes the supply of alcohol
  • Original or a certified copy of the existing licence(s) including any alcohol licence / children's certificate.
  • form of consent from the existing licensee if they are not the applicant.
  • If Alcohol is to be sold or supplied, details as to the identity of and a form of consent from the designated premises supervisor.

A copy of the application needs to be given to your Chief Officer of Police within 48 hours of the application being made.

If you wish to vary your licence you can do so at the same time by completing Part B of the form and providing additional information. Please see applications for variation for further information.

Decision making
Licensees will be automatically granted a premises licence on the same terms as the existing licence (as per the 'grandfathering' provisions), unless there are police objections on the grounds of crime prevention. In which case a hearing will be held by the Council's licensing committee, unless agreed unnecessary by the licence applicant and the police.

Timing
Neither the premises licence nor any variation to existing licence terms will come into effect until the second appointed day (November 2005) at the end of the transition period. Thus, during the transition period, existing licences will continue to be enforceable.

If during this period any licence or certificate under the current legislation is revoked then the new licence must be amended or revoked accordingly.
