Transitional applications
This page will tell you how to apply for a certificate if you are the holder of an existing justices licence.
Existing certificate holdersApplications for grants of club certificates that are to take effect before the end of the transition period (August 2005) will continue to be
made through the licensing justices. For certificates to apply after transition, however, existing certificate holders need to complete Part A of the application form for a new Club Premises Certificate which must be received by the Council between 07 February 2005 and 06 August 2005.
An application for a certificate must be made to the Licensing Authority

You must also, on the same day you give the application to the Licensing Authority, provide a copy of the application and accompanying documents to the Police. If you wish to vary your certificate you can do so at the same time by completing Part B of the form and providing additional information. Please see Varying your certificate for further information.
Decision makingLicensees will be automatically granted a Club Premises Certificate on the same terms as the existing certificate (as per the 'grandfathering' provisions), unless there are police objections on the grounds of crime prevention. In which case a hearing will be held by the Council's licensing committee, unless agreed unnecessary by the certificate applicant and the police.
TimingNeither the Club Premises Certificate nor any variation to existing certificate terms will come into effect until the second appointed day (November 2005) at the end of the transition period. Thus, during the transition period, existing certificates will continue to be enforceable.
If during this period any licence or certificate under the current legislation is revoked then the new certificate must be amended or revoked accordingly.
