Application For Extensions To The Time Limits For Implementing Planning Permissions And Associated Listed Building And/Or Conservation Area Consents

With effect from 1st October 2010 applicants may apply for a new planning permission and associated listed building and / or conservation area consents to replace an existing permission / consent which is in danger of lapsing, in order to extend the time limit for implementation.

When an application made on this form is granted approval, the result will be a new planning permission / consent with a new time limit or limits. The original permission will continue to exist whatever the outcome of the new application.

All sizes and types of development are eligible for this type of application. However, it is not possible to submit such an application if:

  • The development has already commenced
  • The permission or consent has already expired at the time of the application
  • The permission or consent was granted after 1st October 2010
You cannot apply to replace planning permissions or consents in order to extend the time limit for implementation if they have already expired. In those cases, a new application would be needed.

Outline permissions can also be extended provided they are extant both on 1st October 2010 and at the date of application, and have not yet commenced. In cases where the reserved matters have already been approved, they do not have to be applied for again.

For the avoidance of doubt, an outline permission is extant if either:

  • the time limit for the submission of reserved matters has not yet expired; or
  • the reserved matters applications were all submitted in accordance with the time limit for the submission of reserved matters and the time limit for the commencement has not yet expired
What is the process for applying for an extension of a planning permission time limit?
Applications for the extension of a time limit must be made on the standard application form. Visit the planning portal website to download the application form and guidance notes.

  • There is no requirement to provide plans for an application for the extension of a planning permission time limit.
  • A Design & Access Statement is not required
  • EIA Regulations still apply 
  • Section 106 agreements and unilateral undertakings would need to be varied as they would be linked to a particular named planning application
  • There is a right of appeal. The appeals procedure is the same as for other applications

What is the process for applying for an extension of a Listed Building Consent / Conservation Area Consent time limit?
  • Applications for the extension of time limits for Listed Building Consent and Conservation Area Consent should be made as part of the application to extend the time limit of the planning permission and on the same form
  • One copy of the plans are required to accompany applications for the extension of Listed Building and Conservation Area consents.
In cases where there is a need to comply with a statutory requirement in connection with the submission of the application, or a relevant change in policy or other material considerations which post-date the original application, the Council is open to seek further information in support of the application. In most circumstances, however, it is not anticipated that additional information would be required.

The Council may refuse applications to extend the time limit for permissions where changes in the development plan or other relevant material considerations indicate that the proposal should no longer be treated favourably.
