Planning Appeal Information
If the applicant is aggrieved by the decision of the District Planning Authority to refuse an application, or to grant permission or approval subject to conditions, in accordance with Section 78 of the Town and Country Planning Act 1990 he or she may appeal against the decision to the Planning Inspectorate.
The deadlines to appeal are as follows

Applications where an enforcement notice has
been issued against a substantially similar
development before the decision has been made

If the Council fails to decide the application within their statutory target date (usually 8 weeks), the applicant may also appeal to the Planning Inspectorate against this failure. Such appeals must be submitted within the deadlines mentioned above, with the clock running from the statutory target date relevant to the application.

When the Council receive confirmation of an appeal the District Planning Authority will notify all those in writing that made representations to original application. Details of how to make further representations will be contained within this letter, although no further representations can be made on Householder appeals subject to the written procedure. Please note that all representations made on an application which is under appeal will be copied to the Planning Inspectorate in full and may appear on their website.
It is possible to establish whether an application has been subject to appeal by inputting the Council's planning application number into 'Application Search' on the
Council's on-line planning application which is updated daily.
Appeal files including grounds of appeal and corresponding appeal statements are available for the public to view at the Council offices in Capswood during standard opening hours. Certain documents, including appeal decisions once available, can also be viewed on the 'Associated Documents' tab accessed by inputting the Council's planning application number into 'Application Search'
