This Duty of Care Legislation places the responsibility to ensure that waste is treated and disposed of legally on the waste producer. In other words - if you ask someone to take your waste away for you, it is your responsibility to find out where your waste is being taken to for disposal and make sure that they are registered with the Environment Agency as a waste carrier.
